What are the available types of residence permits for Spain?

Foreign citizens who want to immigrate to Spain have several residency options. These are:

  • short-term residency;
  • long-term residency;
  • permanent residency.

What are the types of visas leading to permanent residency in Spain?

Here are the main types of visas that lead to obtaining a permanent residence permit in this country:

  1. employment visas, which are one of the safest ways to obtain permanent residency in this country;
  2. student visas, based on which foreign students can relocate to Spain temporarily and then permanently;
  3. non-lucrative visas, which are available for foreigners seeking to retire to Spain, provided that they have sufficient financial means to support themselves.

Do I need a visa to enter Spain if I am a non-EU citizen and have already applied for a residence or work permit?

Yes, the visa is a different requirement from the residence permit, and is also subject to another, simpler procedure. The difference between them is that the visa enables you to enter Spain, while the residence permit allows you to live here for a specific period of time.

Do I need to apply for a temporary residence permit if I am an EU citizen?

No, as an EU citizen, you only need to register your presence in the country upon arrival; however, you can obtain a permanent residence certificate after living here for the minimum period prescribed by law.

What are the residency requirements applied to EU nationals?

Under Spanish law, within the first three months of your arrival, you need to register at a Foreigners’ Office in order to be added to the Central Register of Foreign Nationals. The residence certificate includes your name, address, your foreigner identification number (NIE), and your nationality. If changes appear in the certificate’s statement, such as a divorce, a marriage, etc., then you have to reapply.

What are the documents to prepare to get a temporary residence permit in Spain?

If you are a non-EU citizen, you must prepare:

  • your valid passport with the visa stamp on it;
  • a valid health insurance;
  • proof of sufficient money that you can sustain your stay in Spain;
  • proof of accommodation;
  • documents attesting to the reason for relocation.

What are the conditions to obtain residency in Spain?

The list below describes the basic conditions for obtaining permanent residency:

  • live in the country for five years: this is a mandatory condition for all who wish to apply for permanent residency and will need to be proved with appropriate documents;
  • have the means to support oneself: the applicant must prove that he or she has a steady income in Spain, either in the form of an employee salary or pension income;
  • be insured: the foreign applicant will need to have private or public health insurance and bring the relevant documentation to support this;
  • submit the application: if all of the above conditions are met, the individual needs to fill in and submit an application to the Foreigner’s Office.

Are there other conditions to obtain permanent residency in Spain other than staying here for 5 years?

Yes, there are other conditions to be met, and these are:

  • you must not have committed offences during your stay;
  • you must have renewed your temporary residence permit in due time;
  • you must prove stable and sufficient resources to support yourself and, where applicable, your family;
  • you must also have valid health insurance at the time of the application.

What are the documents required to obtain permanent residency in Spain?

The proof will consist of various documents, among which we mention the following:

  • information about the current living status (employment contract, self-employed person, student, or retired individual);
  • the registration certificate issued by the local police office in the city where the applicant lives;
  • proof of having a residential address in Spain (utility bills, rental contract);
  • evidence of means of supporting oneself (paychecks, bank statements, etc.).

Based on these documents, the Foreigners' Office (Oficina de Extranjería) will grant the long-term residence authorisation and the National Police will issue the permanent residence card.

Can I leave Spain if I want to obtain permanent residency?

Yes, you can exit the country; however, there are also certain conditions to respect. Specifically, you cannot stay outside of the country for more than 6 consecutive months or 10 months in total in the 5-year period.

What happens if I exceed the stay abroad? How will that affect my plans to become a permanent resident?

The only thing that will happen is that you will have to start over and meet the minimum duration of stay.

Are there any mistakes I should be aware of when applying for permanent residency?

An error our lawyers have seen occur in non-EU citizens is not making sure they have a valid temporary residence permit when applying for the permanent residence card. So, always make sure you renew this document on time.
